A spousal open work permit, or SOWP, is a type of open work permit in Canada that allows the spouse or common-law partner of an eligible principal applicant to work for almost any employer in Canada. No job offer is required. No LMIA is required. The holder can change jobs, work part-time or full-time, and switch industries, all without returning to IRCC for a new permit.
There is one thing applicants need to understand before applying. The SOWP is not a single program. It runs through three legally distinct eligibility tracks, each governed by different rules and different IRCC exemption codes. Your eligibility depends entirely on what your spouse or common-law partner is doing in Canada, not on your own credentials. Being married to someone who works or studies in Canada does not automatically give you the right to work.
Eligibility criteria for the SOWP depend on which track applies to your situation. Each track has its own requirements, its own IRCC application code, and its own history of rule changes. Read all three before assuming which one fits.
As of January 21, 2025, spousal open work permit eligibility for spouses of foreign workers is restricted to specific TEER categories. The principal applicant, the foreign worker, must meet all four of these conditions at the time IRCC makes a decision.
First, the foreign worker must hold a valid work permit or have authorization to work without one. Second, the occupation must be classified as TEER 0 or TEER 1, or fall within a select list of TEER 2 or 3 occupations in labour shortage sectors including natural and applied sciences, construction, health care, natural resources, education, sports, and military roles. Third, at least 16 months of valid work authorization must remain on the foreign worker’s permit at the time IRCC receives the spouse’s application. Fourth, the principal applicant must be living or plan to live in Canada while working.
Spouses of workers on permits under certain free trade agreements remain eligible regardless of TEER classification. If your spouse holds a permit under a free trade agreement, confirm whether that specific agreement includes spousal eligibility.

As of January 21, 2025, spousal open work permit eligibility for spouses of international students is limited to spouses of students enrolled in master’s programs of at least 16 months, doctoral programs, or a specific list of professional degree programs including medicine, law, dentistry, pharmacy, veterinary medicine, nursing, and optometry.
A further restriction took effect on March 4, 2026. Applications under this track are now refused if the principal student is in their final academic term at the time IRCC receives the application. This applies to renewal applications too, not just new ones. If your spouse is finishing their program and your current SOWP is expiring, this rule likely affects your renewal.
For spouses of Post-Graduation Work Permit holders, eligibility requires that the PGWP holder is actively employed in a TEER 0, 1, 2, or 3 occupation. The same 16-month remaining validity requirement applies.

This track is separate from the two above, and it was not affected by either the January 2025 or the March 2026 restrictions. If you are being sponsored for permanent residence by your Canadian spouse or common-law partner under a spousal sponsorship application, you can apply for an open work permit once you receive your Acknowledgement of Receipt, or AOR.
You must be in a genuine relationship, included in a permanent residence application with an AOR letter, and living in Canada with the sponsor. This public policy is currently confirmed through December 31, 2026. Whether it extends beyond that date has not been announced.

For applications submitted inside Canada, the current processing time is approximately 259 days, around 8.5 months. This is a significant increase from the 140 to 196 day range seen in late 2025. IRCC updates processing time estimates weekly, so confirm the current figure at canada.ca before planning your timeline.
For sponsored spouses, the practical clock starts when the AOR arrives, typically 4 to 8 weeks after the PR application is submitted. Budget 10 to 11 months from the initial sponsorship application to the date your spouse can start working.
Check the principal applicant's TEER level, program type, and remaining permit validity before doing anything else. The eligibility rules on both the C41 and C42 tracks have changed twice since January 2025, and a situation that qualified one year ago may not qualify today.

Most SOWP applications are submitted through the IRCC secure portal. Pay the $255 government fee at the time of submission. If biometrics are required and not already on file, you will be directed to a Visa Application Centre after submission.

For the foreign worker and student tracks, the spouse applying from outside Canada does not need to be in Canada at the time of application, but entry to Canada requires a valid visa or eTA in addition to the work permit.
The permit is typically issued for a period matching the principal applicant's remaining valid status, or up to two years in some cases. It can be extended while the underlying situation, a valid work permit, study permit, or PR application in process, continues to meet the eligibility conditions. The passport expiry is also a factor: IRCC will not issue a work permit beyond the passport's expiry date, so renewing the passport before applying avoids a shortened permit period.
